Generally, employees earn one hour of paid time off for each 30-50 hours workers. <strong>Accrual caps vary by state, but accrual is usually capped at around 40 hours, or five 8-hour days of paid time off.<\/strong> Many states allow employees to begin accruing hours as soon as they start working, but employees may not be able to use these hours until they have worked a certain amount of time.<\/p>\n<p>For example, paid sick leave <strong>law California<\/strong>\u00a0says employees can begin to use accrued hours after 90 days of employment. <strong>In some states, accrual may roll over from year to the next.<\/strong><\/p>\n<p>Depending on the state, employees may be able to use paid sick leave to care for sick family members or to take care of domestic disputes. <strong>Meanwhile, others may only allow the time off for personal illness or for specific family members.<\/strong> Like FLMA, some state paid sick leave laws may only apply to businesses of a particular size.<\/p>\n<p>Many cities also have their own paid sick leave laws, which is why it\u2019s best to consult your employment lawyer to find out the correct regulations.<\/p>\n<h2><strong><a id=\"EligibilityforPaidSickLeave\"><\/a>Eligibility for Paid Sick Leave Laws by State in 2024<\/strong><\/h2>\n<p><a href=\"https:\/\/factorialhr.com\/holidays-leaves-software\"><img decoding=\"async\" class=\"alignnone wp-image-116728 size-full\" src=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2023\/09\/15110628\/sick-leave.jpeg\" alt=\"paid sick leave\" width=\"640\" height=\"427\" srcset=\"https:\/\/preproduction.factorialhr.com\/wp-content\/uploads\/2023\/09\/15110628\/sick-leave.jpeg 640w, https:\/\/preproduction.factorialhr.com\/wp-content\/uploads\/2023\/09\/15110628\/sick-leave-300x200.jpeg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<p>Depending on state and local legislation, workers may not be covered by paid sick leave laws for any number of reasons. <strong>For example, independent contractors, work-study students, real estate agents, and agricultural workers may not be eligible for paid leave benefits in certain states<\/strong>. Employees and employers should check local and state guidelines.<\/p>\n<p>In order to receive paid sick leave according to paid sick leave law in California,<strong> employees must work 30 days within a year for the same employer and satisfy the 90-day employment period.<\/strong> Other states may have similar obligations that employees must meet before they can take advantage of paid sick leave benefits. Employees should check their eligibility for paid sick leave.<\/p>\n<h2><a id=\"PaidSickLeaveLawByIndustry\"><\/a>Paid Sick Leave Law By Industry 2024<\/h2>\n<p>Employers may provide employees with paid sick leave plans more generous than those required by state or local law.<strong> In certain industries, employers use leave plans to attract talented workers and keep their workplace healthy.<\/strong> Unfortunately, this coverage is usually limited to higher wage-earners. A survey from the Bureau of Labor Statistics (BLS) shows while 92% of top earners have access to sick leave,\u00a0<a href=\"https:\/\/www.bls.gov\/ncs\/ebs\/\" target=\"_blank\" rel=\"noopener noreferrer\">among the lowest earners, only 31% have sick leave<\/a>.<\/p>\n<p>Sick leave is more common in the public sector than in private business, although it varies widely by profession. <strong>Teachers (96%), business workers (94%), and nurses (90%) are among the most likely to have paid sick leave.<\/strong> <strong>Production (68%), sales (64%) and agricultural workers (59%) are among the least likely.<\/strong> Access to sick leave also varied based on the size of the business, as well as its geographical location.<\/p>\n<p>On average, private sector workers receive\u00a0<a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2020\/03\/12\/as-coronavirus-spreads-which-u-s-workers-have-paid-sick-leave-and-which-dont\/\" target=\"_blank\" rel=\"noopener noreferrer\">7 days of sick leave per year<\/a>. Meanwhile, just about a quarter of American workers receive less than 5 days a year. <strong>While industry currently plays an important role in determining access to paid sick leave, legislation may shore up the gap between industries.<\/strong><\/p>\n<h2><a id=\"PaidSickLeaveLawsByState\"><\/a>Paid-Sick-Leave Laws By State in 2024<\/h2>\n<p><a href=\"https:\/\/factorialhr.com\/holidays-leaves-software\"><img decoding=\"async\" class=\"alignnone wp-image-116410 size-full\" src=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2023\/09\/12154625\/payroll-USA.jpeg\" alt=\"paid sick leave by state\" width=\"640\" height=\"427\" srcset=\"https:\/\/preproduction.factorialhr.com\/wp-content\/uploads\/2023\/09\/12154625\/payroll-USA.jpeg 640w, https:\/\/preproduction.factorialhr.com\/wp-content\/uploads\/2023\/09\/12154625\/payroll-USA-300x200.jpeg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<h3>Alabama<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Alaska<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"https:\/\/www.azica.gov\/frequently-asked-questions-about-wage-and-earned-paid-sick-time-laws\">Arizona<\/a><\/h3>\n<p>All employers in Arizona have to provide paid sick leave, except casual babysitters and employees of the state or federal government, or parents and siblings.<\/p>\n<h3>Arkansas<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"https:\/\/www.dir.ca.gov\/dlse\/ab1522.html\">California<\/a><\/h3>\n<p>A Californian who works 30 hours a year is entitled to one hour of paid leave for every 30 hours worked. They can take 24 hours or three days a year.<\/p>\n<h3><a href=\"https:\/\/leg.colorado.gov\/bills\/sb20-205\">Colorado<\/a><\/h3>\n<p>Starting Jan. 1, 2021, Colorado employers with at least 16 employees have to offer p. sick leave to their employees, and everyone else has to start Jan. 1, 2022.<\/p>\n<h3><a href=\"https:\/\/www.ctdol.state.ct.us\/wgwkstnd\/sickleave.htm\">Connecticut<\/a><\/h3>\n<p>There are some exceptions in Connecticut, but employers with more than 50 employees have to offer p. sick leave.<\/p>\n<h3>Delaware<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Florida<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Georgia<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Hawaii<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Idaho<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Illinois<\/h3>\n<p><a href=\"https:\/\/www.chicago.gov\/city\/en\/depts\/bacp\/supp_info\/paidsickleaveinfo.html\">Chicago<\/a><\/p>\n<p>Chicago businesses must give their employees p. sick leave.<\/p>\n<p><a href=\"https:\/\/www.cookcountyil.gov\/service\/earned-sick-leave-ordinance-0\">Cook County<\/a><\/p>\n<p>Employers in Cook County have to give their employees p. sick leave, but there are exceptions for federal, state and local government employees and construction workers with collective bargaining agreements. Federal employees, Massachusetts cities and towns, and some educational institutions don&#8217;t have to provide it.<\/p>\n<h3><a href=\"https:\/\/www.michigan.gov\/documents\/lara\/Paid_Medical_Leave_Act_FAQ_003_644567_7.pdf\">Michigan<\/a><\/h3>\n<p>In Michigan, most private employers with at least 50 employees have to offer p. sick leave to their nonexempt workers.<\/p>\n<h3><a href=\"https:\/\/www.dli.mn.gov\/sick-leave\">Minnesota<\/a><\/h3>\n<p>Any business or person with one or more employees can accrue up to 48 hours of ESSL annually starting Jan. 1, 2024. Part-timers and temp workers get one hour of ESSL for every 30 hours worked.<\/p>\n<h3>Mississippi<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Missouri<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Montana<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Nebraska<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"http:\/\/labor.nv.gov\/About\/Frequently_Asked_Questions\/Frequently_Asked_Questions_-_About_Us\/\">Nevada<\/a><\/h3>\n<p>The majority of private employers in Nevada must provide paid leave accruals at the rate of 0.01923 hour for each hour of work performed. Leave can be used for any reason, including vacations.<\/p>\n<h3>New Hampshire<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"https:\/\/www.nj.gov\/labor\/wagehour\/lawregs\/wage_and_hour_laws.html\">New Jersey<\/a><\/h3>\n<p>Workers in New Jersey are usually guaranteed paid sick leave, but there are exceptions for construction workers covered by a collective bargaining agreement and per-diem health care workers.<\/p>\n<h3><a href=\"https:\/\/www.nmlegis.gov\/Sessions\/21%20Regular\/bills\/house\/HB0020JCS.pdf\">New Mexico<\/a><\/h3>\n<p>New Mexico employees will get up to 64 hours of leave a year starting July 1, 2022.<\/p>\n<h3><a href=\"https:\/\/www.ny.gov\/programs\/new-york-paid-sick-leave\">New York<\/a><\/h3>\n<p>If you have five or more employees or a net income over $1 million, you have to give sick leave to employees in New York. If you have four or fewer employees, you have to give sick leave without pay.<\/p>\n<h3>North Carolina<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>North Dakota<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Ohio<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Oklahoma<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"https:\/\/www.oregon.gov\/boli\/employers\/Pages\/COVID-19-resources.aspx\">Oregon<\/a><\/h3>\n<p>In Oregon, employers with 10 or more employees must provide p. sick leave to their workers. Employers with six or more employees must provide unpaid sick leave if they have operations in Portland.<\/p>\n<h3>Pennsylvania<\/h3>\n<p><a href=\"https:\/\/www.phila.gov\/media\/20191218103833\/Paid-Sick-Leave-Poster-Translations.pdf\">Philadelphia<\/a><\/p>\n<p>Philadelphia employers with at least ten employees have to provide p. sick leave. Smaller companies have to provide unpaid leave.<\/p>\n<p><a href=\"https:\/\/www.alleghenycounty.us\/administrative\/paid-sick-leave-faqs.aspx\">Allegheny County<\/a><\/p>\n<p>A paid-sick-leave ordinance took effect in Allegheny County on Dec. 15, 2021. However, fines might not be imposed until one year after the effective date, i.e., Dec. 15, 2022.<\/p>\n<p><a href=\"https:\/\/pittsburghpa.gov\/mayor\/paidsickleave\">Pittsburgh<\/a><\/p>\n<p>Pittsburgh requires private employers to provide sick leave to their workers. Accruals are capped at different rates depending on the size of the company.<\/p>\n<h3>Rhode Island<\/h3>\n<p>Workers in Rhode Island have the right to p. sick leave from employers with 18 or more employees. Smaller businesses don&#8217;t have the right.<\/p>\n<h3>South Carolina<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>South Dakota<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Tennessee<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3>Texas<\/h3>\n<p>The Local Laws are Blocked by Courts Here.<\/p>\n<h3>Utah<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"https:\/\/labor.vermont.gov\/sites\/labor\/files\/doc_library\/Earned-Sick-Time-Rules.pdf\">Vermont<\/a><\/h3>\n<p>In Vermont, employees who work 18 hours or more a week or more over the course of the year are entitled to p. sick leave.<\/p>\n<h3>Virginia<\/h3>\n<p class=\"pb-2\" data-private=\"redact\" data-wt-guid=\"245799ef-11b4-46d1-bae6-2ce80df71acd\" data-pm-slice=\"1 1 []\">State law does not regulate sick leave.<\/p>\n<h3><a href=\"https:\/\/www.lni.wa.gov\/workers-rights\/leave\/paid-sick-leave\/\">Washington<\/a><\/h3>\n<p>For every 40 hours worked, Washington employees get one hour of p. sick leave.<\/p>\n<h3><a href=\"https:\/\/code.dccouncil.us\/dc\/council\/code\/sections\/32-531.02.html\">Washington, D.C.<\/a><\/h3>\n<p>Employers in Washington, D.C., are required to offer p. sick leave, although there are some exceptions for federal employees.
